Rajita Sharma specialises in all areas of intellectual property law, including patents, trademarks, copyright, design rights, databases and related competition law. Her focus is on the life sciences and India.
She represents a range of clients, companies and individuals, in the life sciences, pharmaceuticals, consumer and luxury goods, and shipping sector.
She has extensive experience of complex IP litigation. Patent disputes have covered infringement, validity and oppositions. Areas of technology have included biotechnology, medical equipment, drug formulations, chemical processes, consumer products, multi hull ships and software. In the life sciences sector she has worked on HIV drugs, cancer drugs, cell surface proteins, immunology, antiviral therapies, gene sequencing and assay methods.
Trade Mark matters include infringement, passing off, comparative advertising and parallel imports.
Apart from conducting matters in the English Courts, the EPO and the Community Trade Marks Office, she conducts and manages multi-jurisdictional matters in various countries including the USA, Australia and India.
On the transactional side she advises on the IP aspects of corporate transactions such as mergers, acquisitions and joint ventures. She also advises on commercial arrangements, technology transfer, collaborations, R and D, sponsorship and license and assists businesses to devise strategies for the procurement, exploitation and enforcement of IP rights and IP asset management.
Apart from England and Wales she is qualified to practice in India and frequently advises on India related IP/patents and commercial matters.
Rajita is a member of INTA, INTA Committee on ADR and PTMG
